1. Acceptance of Terms

By accessing or using Gofolio ("the Service", "we", "us"), creating an account, or syncing portfolio data, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the Service.

2. Data Storage, Architecture & Privacy

Gofolio prioritizes user privacy and transparency in how data is stored and handled across different operational modes:

Local-First Guest Mode: When using the platform without creating an account or signing in, all your portfolio data (including stock assets, transactions, cash accounts, options contracts, and alert configurations) is stored exclusively in your local browser storage (LocalStorage / IndexedDB). No financial data is sent to or stored on our servers.
Cloud Synchronization (Registered Users): If you choose to create an account and register with an email address, your portfolio assets, transaction history, options, cash balances, and alert configurations are securely stored and synced in real-time via Google Firebase Realtime Database. This enables cross-device synchronization between your desktop and mobile browsers.
Push Notification Alerts: When you enable browser Web Push notifications, your push notification subscription and active alert rule criteria are securely registered with the server so the background monitor can dispatch alerts to your device when market conditions trigger.
Protection of User Personal Information (Email, Name, Identity): Your personal registration information (such as your email address, username, or account credentials) is used solely and strictly for user authentication and encrypted account sync. We do not use your personal details for marketing or unsolicited outreach, we never display your information publicly or to other users, and we never share or distribute user identifiers to any third parties.
No Data Selling or Sharing: We do not monetize, rent, share, or sell your personal portfolio data, holdings, trading activities, email address, or any financial information to third parties, data brokers, or advertisers.
Analytics & Cookies: Optional Google Firebase Analytics tracking is strictly opt-in via our consent banner. You may revoke consent at any time by clearing site data or updating cookie settings. See our Privacy Policy for full details.

3. Google Firebase & Google Analytics Terms

Gofolio utilizes Google Cloud and Google Firebase services (provided by Google LLC) to provide secure cloud backend features:

Firebase Authentication & Cloud Database: When you register an account or synchronize portfolio data, your credentials and portfolio data are processed via Google Firebase. This infrastructure is maintained in compliance with Google Cloud security and privacy standards. Access is secured by strict server-side rules ensuring that only your authenticated account can access your synchronized portfolio.
Google Firebase Analytics (Opt-In Only): We use Google Firebase Analytics to collect aggregated, anonymized technical telemetry (such as page load speeds, browser metrics, and feature interactions) to diagnose bugs and improve platform performance.
No Financial Data in Analytics: We never send your portfolio assets, transaction values, cash amounts, or financial figures to Google Analytics.
Third-Party Policies: Use of these features is also governed by the Google Privacy Policy and Google Firebase Terms of Service.

4. European Union (EU) Regulatory & GDPR Compliance

For users residing in the European Economic Area (EEA) and European Union:

Lawful Bases (GDPR Art. 6): Processing of account data and portfolio sync is conducted under contractual necessity (Art. 6(1)(b)). Optional analytics cookies and web push notifications are processed solely on the basis of explicit, revocable consent (Art. 6(1)(a)).
EU Data Residency: Firebase cloud database servers are located in Belgium (europe-west1, European Union), ensuring compliance with EU cross-border data transfer regulations.
Enforceable Data Subject Rights: You may at any time exercise your rights under GDPR Articles 15–22 (access, rectification, data portability, erasure / "right to be forgotten", and consent withdrawal) via the application interface or by clearing your browser cache.
Non-Advisory Self-Directed Tool: Gofolio is a self-directed, execution-only technology platform and does not provide investment advisory services or portfolio management regulated under Directive 2014/65/EU (MiFID II).

5. Behavioral Analytics & Self-Reflection Tools

The platform includes behavioral tracking and discipline auditing features (such as the Behavioral Auditor, panic-selling detection, FOMO buying alerts, and trading frequency metrics).

These tools analyze your input transaction timestamps and portfolio changes against historical market movements. They are purely mathematical heuristics designed for educational self-reflection, discipline tracking, and habit awareness. They do not constitute psychological or financial advisory services.

6. Strict "Not Financial Advice" Disclaimer

The calculations, models, and analytics provided by Gofolio—including but not limited to:

Discounted Cash Flow (DCF) & Free Cash Flow intrinsic valuation models,
Black-Scholes option pricing, implied volatility (IV) crush simulations, and theta decay estimates,
Market hedging gauges, flip scores, DeMark Sequential indicators, and GARCH volatility models,
Portfolio diversification, Sharpe ratio, and profit/loss metrics,

are computed based on public market data, user input parameters, and mathematical algorithms. They are provided strictly for informational and educational purposes.

Past performance is not indicative of future results. You should not construe any information, indicator, alert, or chart provided on this site as financial advice or an endorsement to buy, sell, or hold any security, cryptocurrency, option, or other financial asset. Always conduct your own independent research and consult with a licensed professional financial advisor before making investment decisions.

7. Market Data Accuracy & Third-Party Services

Market prices, currency exchange rates, company financial metrics, and options chains are sourced via Yahoo Finance and third-party APIs. Market data may be delayed, incomplete, or subject to interruptions beyond our control. Gofolio and its operators assume no liability for errors, delays, or omissions in market data feeds.

8. User Account, Personal Information & Confidentiality

You are responsible for maintaining the confidentiality of your authentication credentials. Your personal details—including your email, name, and portfolio records—are strictly private, never exposed to other users or public directories, and never shared with third-party tracking networks.

9. Limitation of Liability & "As-Is" Warranty

The Service and all quantitative calculations are provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Gofolio, its creators, and operators shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including loss of profits, capital, investments, data, goodwill, or service interruptions resulting from:

Your use or inability to use the platform,
Any financial or trading decisions made based on charts, models, fair values, or indicators,
Errors, omissions, inaccuracies, or delays in third-party market data feeds,
Unauthorized access to or alteration of your transmissions or data.

10. No Automated Decision-Making (GDPR Art. 22)

Gofolio does not employ automated decision-making or legal profiling algorithms that produce legal effects or significantly affect users. All calculations, alerts, and heuristics are strictly computational aids for personal, human-directed analysis.

11. Age Requirement & Eligibility

The Service is intended exclusively for individuals who are at least 18 years of age (or the legal age of majority in their jurisdiction) and legally capable of managing financial accounts. We do not knowingly collect or solicit data from minors.

12. Intellectual Property & User Data Ownership

You retain 100% ownership of your portfolio holdings, transactions, and custom data. The Gofolio platform, including its software code, design systems, algorithms, interfaces, and branding, is the exclusive intellectual property of Gofolio and protected by applicable copyright and intellectual property laws.

13. Severability & Governing Law

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. These Terms shall be governed by and construed in accordance with applicable laws without regard to conflict of law principles.
